PRIVACY & SAFETY

The General Terms and Conditions as described here apply to every product offered on the Lux webshop and all deliveries. Every order implies acceptance of the terms and conditions of sale. The General Terms and Conditions of Lux are exclusively governed by Belgian law. The consumer has the right to inform the seller that he renounces the online purchase, without having to pay a fine and without having to state a reason, within 14 calendar days from the day following the delivery of the product.

PURCHASE & PAYMENT


The agreement between Lux and you as purchaser shall come into effect at the time when you have accepted and complied with the conditions set by Lux, subject to the right to renounce the sale as provided above . The absence of an ordinary signature shall not affect the binding force of the offer and its acceptance. Lux reserves the right to refuse an order or to subject it to additional conditions, such as for large orders, orders placed by minors, incomplete order procedures or problems with previous orders. Lux always confirms the purchase by e-mail. If a confirmation email has not yet been sent, the agreement is not yet in effect. Payment for products purchased from Lux shall be made exclusively in advance by bank transfer. The seller remains the owner of all goods until full payment has been made. In the event of late payment, Lux shall be entitled to dissolve the agreement with immediate effect or to suspend (further) delivery until such time as you have fulfilled your payment obligations in full. The General Terms and Conditions and the confirmation e-mails are always drawn up in the language of the website. 


DELIVERY & DELIVERY TIMES


The delivery of the Product(s) that are the subject of the transaction are made by the Vendor, anywhere in Belgium. The Vendor will make every effort to ensure that the order is sent to the address provided by the Customer within a few days following the confirmation of the order. 

As soon as the products to be delivered have arrived at the delivery address given, the risk, as far as these products are concerned, is transferred to the Buyer.

PAYMENT METHODS

RIGHT OF WITHDRAWAL & RETURN PROCEDURES


For all products purchased online from Lux, according to the Belgian Law on Trade Practices, Information and Consumer Protection of April 6, 2010, you have a cooling-off period of 14 calendar days. During the cooling-off period, we expect you to handle the goods and packaging with care. There is no right of renunciation if the product and its packaging are no longer in their original, complete, undamaged and unused condition. If you wish to use the right of renunciation, you must return your items within the stipulated 14 calendar days from the day following the delivery of the product (ADRES X)

There is no penalty attached to cancelling the purchase, but we do ask you to give a reason so that we can serve our customers even better in the future. More information on cancelling or returning your order can be found in the shipping and returns section of our website. The goods should be returned undamaged, unused and unopened (in original condition and packaging) at the latest within 14 calendar days after receipt. The shipping date is used as a check. All enclosed documentation and packaging materials must be enclosed with the return shipment, as well as your name and order number. The direct costs for the return are to be borne by the buyer. Unstamped or insufficiently stamped shipments will always be refused and returned to sender. Lux will refund the purchase price within 14 days following the withdrawal. If it appears that the goods have not been received in accordance with the conditions of the right of withdrawal, the purchase amount will not, or not completely, be refunded. 

DEFECTS

You are obliged to carefully inspect the goods immediately upon receipt. In doing so, you should check whether the goods supplied are in accordance with the agreement: - Were the correct goods delivered? - Do the delivered goods comply with the agreed quality requirements or - if these are lacking - with the requirements that may be set for normal use? The customer undertakes to take delivery of the goods sold and to examine whether the quality and/or quantity of the goods delivered corresponds to what was agreed. Any visible defects concerning the goods delivered must be communicated in writing to Lux without delay and no later than 48 hours after delivery. Complaints on account of visible defects shall only be valid and shall be examined on condition that the goods sold have not yet been put into use by the customer. Such complaints shall not suspend the customer's obligation to pay. The customer must notify Lux in writing of any hidden defect within a period of 2 months from its discovery. In the absence of such notification, the customer shall forfeit his right to make a claim for hidden defects. The costs of returning goods that do not comply with the description of the offer shall be borne by Lux.
 

FORCE MAJEURE

Force majeure shall be understood to refer to all external causes, whether anticipated or not, over which Lux cannot exercise any control, but as a result of which Resolute is unable to fulfil its obligations. Lux shall also be entitled to invoke force majeure if the circumstance preventing (further) fulfilment arises after Lux should have fulfilled its obligation. During force majeure, Resolute's delivery and other obligations shall be suspended. If the period in which fulfilment of L's obligations is not possible due to force majeure lasts longer than 8 weeks, both parties shall be entitled to dissolve the agreement without any obligation to pay compensation in such case. We shall always endeavour to reimburse payments for cancelled orders and for returns within a period of 8 weeks.

DISPUTES

These General Terms and Conditions are subject to Belgian law. Any dispute for which an amicable settlement could not be found falls within the exclusive competence of the courts of the judicial district of Mechelen. The exchanges between the two Parties, kept by the Vendor, will be considered as evidence that may be taken into consideration.
